When a classified installation changes its operator, the new operator must make a declaration to the prefect within one month of his appointment. This declaration should mention in the case of an individual, the surname, forename and home address of the new operator and, in the case of a corporation, its name or legal denomination, legal form, head office address as well as the title of the person signing the declaration. A sender’s receipt is provided (articles R512-68 and R512-74 to R512-80 of the environmental code).

The installations subject to the existence of financial guarantees and whose change in operator is subject to prefect authorisation are as follows :

• Waste storage facilities ;
• quarries ;
• installations mentioned on the list provided in article L 515-8 of the environmental code. The permit application to change the operator, with documents attached demonstrating the new operator’s technical and financial capacity and the constitution of financial guarantees, should be sent to the prefect. The decision is made within three months of receipt of the application. (article R516-1 of the environmental code)
